These Terms of Service (“Terms”) govern your use of the Shellegance website and services. Shellegance operates under Studio Lucie de Moyencourt (PTY LTD), based in Gardens, Cape Town, South Africa.

By accessing or purchasing from Shellegance, you agree to be bound by these Terms.

1. Business Information

Shellegance is a brand operated by Studio Lucie de Moyencourt (PTY LTD).

2. Products & Services

Shellegance offers:

  • Handmade ceramic shells and vases
  • Fine art prints (made to order)
  • Custom pieces
  • Limited edition and one-of-a-kind drops

All ceramics are handmade and may contain natural variations, which are part of their uniqueness and not considered defects.

3. Orders & Payment

We accept:

  • Card payments
  • American Express
  • Apple Pay

Order Confirmation:
An order is only considered confirmed once a waybill has been issued, indicating the order has been packaged and is ready for shipment.

Order Cancellations:
In the rare event of a double sale of the same item:

  • The customer who completed payment first will receive the item
  • The other customer will be offered either:
    • A full refund, or
    • A voucher for a future collection drop

We reserve the right to cancel orders due to errors, stock issues, or unforeseen circumstances.

4. Shipping & Delivery

We ship both locally within South Africa and internationally.

Estimated Delivery Times:

  • Local: 1–2 business days
  • International: 7–14 business days (depending on shipping method)

Shipping Partners:

  • Local: The Courier Guy
  • International: Tunl (via UPS and FedEx)

While we aim to meet delivery estimates, delays may occur. Please contact us at ryan@luciedemoyencourt.com for assistance with any shipping issues.

5. Returns & Refunds

Please refer to our Return & Refund Policy below:

Damaged Items:

  • Refunds are offered for items damaged in transit
  • Customers may choose between:
    • A refund to their original payment method, or
    • A voucher for a future drop
  • Damage must be reported within 48 hours of delivery, with supporting photographs

Returns:

  • Assessed on a case-by-case basis
  • Accepted only if:
    • Item is unused, unopened, and in original packaging
    • Returned for inspection and deemed resellable
  • Applies to South African orders only

Fine Art Prints:

    • All Fine Art Prints are made to order as part of a print-on-demand service
    • Please allow 3–5 business days for printing, followed by approximately 3 business days for shipping
    • As each print is produced specifically for your order, we do not offer refunds or exchanges for:
      • Incorrect size selection
      • Change of mind

All sizes and specifications are clearly listed on our website. Customers are responsible for reviewing these details before completing their purchase.

6. Breakages & Insurance

All ceramic shipments are insured.

If your order arrives damaged, you must provide:

  • Photos of the outer packaging (showing visible damage)
  • Photos of the broken item(s)
  • Any additional images to support an insurance claim

Failure to provide sufficient evidence may affect your claim.

7. Intellectual Property

All content associated with Shellegance is the intellectual property of Studio Lucie de Moyencourt, including:

  • Ceramic designs
  • Fine art prints
  • Textile designs (including tea towels and tablecloths)
  • Photography, branding, and website content

You may not:

  • Copy, reproduce, or replicate designs
  • Use images or branding without permission
  • Commercially exploit any Shellegance content

We reserve the right to take legal action in cases of infringement.

8. User Conduct

By using our website, you agree not to:

  • Engage in fraudulent activity
  • Attempt to copy or reproduce products or designs
  • Misuse or interfere with the website functionality

Unauthorised use of our intellectual property is strictly prohibited.

9. Limitation of Liability

Shellegance is not liable for:

  • Indirect, incidental, or consequential damages
  • Losses resulting from misuse of products
  • Delays caused by couriers or external factors beyond our control

All products are used at the customer’s own risk.

10. Privacy

We collect customer information for:

  • Order processing
  • Shipping and delivery
  • Marketing communications (where consent is given)

11. Governing Law

These Terms are governed by the laws of South Africa.

12. Promotions & Discounts

  • Promotions and discounts are subject to availability and may be withdrawn at any time
  • Discount codes cannot be applied retroactively
  • Only one promotion may be used per order unless otherwise stated

13. Age Restrictions

By using this website, you confirm that you are at least 18 years old or have permission from a legal guardian.

14. Changes to Terms

We reserve the right to update or modify these Terms at any time. Changes will take effect immediately upon being posted on the website.
